Introduction
These terms and conditions govern your use of this website, hereafter referred to as “The Site”; through your use of the Site, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website.
The Site does use cookies, and information gathered from cookies for data collection purposes and by using the Site and agreeing to these terms and conditions, you consent to our Denver Real Estate School, LLC’s (hereafter referred to as “Denver Real Estate School”) use of cookies in accordance with the terms of Denver Real Estate School's privacy policy, see “Privacy Policy” section below.
License To Use The Site
Unless otherwise acknowledged, Denver Real Estate School and/or its agents, affiliates, or partners are the sole owners of the intellectual property rights regarding the Site, the services offered on the Site, and any other available materials on the Site. Subject to the license set forth in these terms and conditions, all these intellectual property rights are reserved for the sole use of Denver Real Estate School and all other interested stakeholders.
Information or content presented on the Site may be viewed; downloaded for caching purposes only; and pages from the Site may only be printed strictly for your own personal use, and any printed materials are subject to the limitations set forth below and elsewhere in these Terms and Conditions.
Denver Real Estate School strictly prohibits users of the Site from:
Republishing material from the Site (including republications on other websites); sell, rent or otherwise redistribute ownership of any material available on the Site; display any material from the website in public without the expressed written consent of Denver Real Estate School and its agents, affiliates, or partners; overseeing the reproduction, duplication, copying or otherwise exploitation of any materials available on the Site for any non-authorized commercial purpose; redistributing content from the Site purposely and explicitly made presented for redistribution, or with the expressed written consent of Denver Real Estate School, for any commercial purpose not specifically permitted by Denver Real Estate School; editing or otherwise altering any materials available on the Site without the expressed written consent of Denver Real Estate School or its agents, affiliates, or partners;
Any such related content specifically made available for redistribution may only be redistributed for personal use, for informational or educational uses or for any use authorized by Denver Real Estate School, its agents, affiliates, or partners.
Acceptable Use
By reading this you agree that you must not use the Site in any way which causes, or may cause, damage to the website or interference of the accessibility of the Site; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any such related activity.
By reading these Terms and Conditions you also agree that you must not use the Site to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
You must not perform any methodical or computerized data collection activities (including without limitation scraping, data mining, data extraction, data harvesting, etc.) on or in relation to the Site without Denver Real Estate School’s expressed written consent.
Use of the Site to transmit or send unsolicited commercial communications is strictly prohibited by Denver Real Estate School.
Use of the Site or any purposes related to marketing without Denver Real Estate School’s express written consent is also strictly prohibited.
Limitations of liability
Denver Real Estate School will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website: to the extent that specified content on the website is provided free-of-charge, for any direct loss in relation to visitation of the site; for any indirect, special or consequential loss; or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
These limitations of liability apply even if Denver Real Estate School has been expressly advised of the potential loss.
COURSE COMPLETION: Each student is allowed (6) six months, (8) eight months, or one (1) year from date of enrollment (based of enrolled program) to complete licensing program. After that time, a new registration is required.
STUDENT TEXTBOOKS: Course textbooks are required for the respective programs. The textbooks may be purchased from Denver Real Estate School, LLC or any other vendor. In the event the student elects to purchase the books from Denver Real Estate School, LLC, said textbooks will be available by the first class.
APPLICATION OF PAYMENTS: All payments received under the terms of this agreement shall be applied as follows: First to textbooks and student course texts, second to the payment of tuition and third to the payment of the tape deposit or other fees.
SUSPENSION: The school may suspend any student from immoral or improper conduct as defined in the school catalog. The school reserves the right to be the sole judge of such conduct which may be detrimental to the school. Monies retained by the school will be in accordance with the refund policies as herein stated.
PLACEMENT: The school does NOT GUARANTEE positions of employment. However, options may be implemented.
FEES PAYABLE: All fees are payable per the terms of this agreement. Promissory notes are neither solicited nor accepted. Authenticated Visa, Master Card, Discover and American Express charge cards are accepted. Upon request, the school will invoice a third party designated by the student providing, however, that the student will be the primary party responsible for the timely payment of the aforesaid fees. Notwithstanding and other provision herein, textbooks and/or notes shall not be provided until the appropriate fee is paid. When collecting a debt Denver Real Estate School shall charge a $50.00 administration fee on all back charges or declined payments that are not resolved through Denver Real Estate School directly.
POSTPONEMENT OF A STARTING DATE: Postponement of a starting date, whether at the request of the school of the student, requires a written agreement signed by the student and the school. The agreement must set forth:
a.) Whether the postponement is for the convenience of the school or the student.
b) A deadline for the new start date, beyond which the start date will not be postponed.
If the course is not commenced, or the student fails to attend by the new start date set forth in the agreement, determined in accordance with school refund policy and all applicable laws and rules concerning the Private Occupational Act of 1981.
REFUND POLICY: This school maintains a policy for the refund of prepaid tuition and fees in the event, and within thirty days of the date a student fails to enter the course, withdraws, of has been discontinued therefore at any time prior to completion, and our policy provides as follows:
a) A full refund of all monies paid if the applicant is not accepted by the school.
b) A full refund of tuition and fees paid if the applicant withdraws within three days after signing this contract or making an initial payment, provided that the applicant has not commenced training. If applicant withdraws after three days of signing this contract (purchasing an online course), but before commencing classes, applicant is entitled to full refund of all tuition and fees paid except for cancellation fee of $150.00
c) A full refund of the tuition and fees paid in the event that the school discontinues a course or program of education during a period of time within which a student could have reasonably completed the same, except that this provision shall not apply in the event that the school ceases operation.
d) Except for the $150.00 cancellation charge or 25% of course tuition whichever is less stated in the item labeled TUITION. A refund of the tuition and fees paid shall be made as follows.
- For a student terminating his/her training within the first 10% of his/her program, the student shall be entitled to a refund of 90% of the contract price of the program exclusive of books and supplies.
- For a student terminating his/her training after 10%, but within the first 25% of his/her program, the student shall be entitled to a refund of 75% for the contract price of the program exclusive of books and supplies.
- For a student terminating his/her training after 25% but within the first 25% of his/her program, the student shall be entitled to a refund of 50% of the contract price of the program exclusive of books and supplies.
- For a student terminating his/ her training after 50% but within the first 75% of his/her program, the student shall be entitled to a refund of 25% of the contract price of the program exclusive of books and supplies.
- A student who has completed 75% of his/her program and has entered the final 25% shall not be entitled to any refund and shall be obligated for the full price for the program, which constitutes the maximum obligation.
e) The method of determining the official termination date of the student shall be as follows:
- The date on which the school receives written notice of the student’s intention to discontinue the training program.
- The date on which the student violates published school policy which provides for termination and is based on classroom contact hours or lessons completed.
For the purposes of adhering to the REFUND POLICY as stated above, a correspondence student shall be deemed to have completed 3 lessons per week from the date of signing the enrollment agreement. The policy for the granting of credit for previous training shall not impact the refund policy.
ALL REFUNDS WILL BE MADE WITHIN 30 DAYS OF THE TERMINATION DATE. Exceptions
Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit, and nothing in this website disclaimer will exclude or limit Denver Real Estate School’s liability with respect to any: death or personal injury caused by Denver Real Estate School’s negligence; fraud or fraudulent misrepresentation on the part of Denver Real Estate School by a court’s proper jurisprudence; or matter which it would be illegal or unlawful for Denver Real Estate School to exclude or limit, or to attempt or purport to exclude or limit, its liability.
Reasonableness
By using the Site, you agree that the exclusions and restrictions of liability set out in this website disclaimer are reasonable.
If you do not think they are reasonable, you must not use the Site.
Other Parties
You accept that, as a limited liability entity, Denver Real Estate School, has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against Denver Real Estate School’s officers or employees in respect of any losses you suffer in connection with the website.
Without prejudice to the preceding paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Denver Real Estate School’s officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Denver Real Estate School.
Unenforceable Provisions
If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.
Indemnity
You hereby indemnify Denver Real Estate School and undertake to keep Denver Real Estate School indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Denver Real Estate School to a third party in settlement of a claim or dispute on the advice of Denver Real Estate School’s legal advisers) incurred or suffered by Denver Real Estate School arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
Breaches of these terms and conditions
Without prejudice to Denver Real Estate School’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Denver Real Estate School may take such action as Denver Real Estate School deems appropriate to deal with the breach,
including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
Variation
Denver Real Estate School may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.
Assignment
Denver Real Estate School may transfer, sub-contract or otherwise deal with Denver Real Estate School’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
All other persons and/or parties are strictly prohibited from transferring, sub-contracting or otherwise reassigning any expressly granted rights and/or obligations under these terms and conditions.
Severability
If any section or provision set forth in these terms and conditions subsequently is determined by any court or other competent authority to be unlawful and/or unenforceable, all provisions set forth in all other sections shall continue in effect. Any unlawful and/or unenforceable provision would be lawful or enforceable part of it were removed from these terms or otherwise modified, that section will be assumed to have been deleted, and all provisions set forth in all other sections shall continue in effect.
Entire agreement
These terms and conditions, together with the Privacy Policy, constitute the entire agreement between you and Denver Real Estate School in relation to your use of the Site, and supersede all previous agreements in respect of your use of the Site.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID19

The coronavirus, COVID19, has been declared a worldwide pandemic by the World Health Organization. COVID19 is extremely contagious and is believed to spread mainly from person to person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations prohibited the congregation of groups of people.
Denver Real Estate School has put in place preventative measures in accordance with state and federal laws, to reduce the spread of COVID19. However, Denver Real Estate School cannot guarantee that you will not become infected with COVID19. Attending the onsite classes or other in person activities related to Denver Real Estate School training could increase your risk of contracting COVID19.
I agree to do my part to use Denver Real Estate School’s provided, or my own personal PPE, hand sanitizer, face masks and social distance myself 6 feet from another person and wash my hands frequently. I agree and understand that I am responsible for keeping myself safe and utilizing the resources provided. If I show signs of COVID19 symptoms I agree to self-quarantine until I am tested for COVID19 or symptoms have passed at least 7 days. Symptoms include fever, shortness of breath or difficulty breathing, coughing, including early symptoms such as chills, body aches, sore throat, headache, diarrhea, nausea/vomiting, and runny nose.
I agree that if I am infected with COVID19 I will notify Denver Real Estate School immediately and will cease attendance until I receive a written waiver from a licensed health care provider stating I am no longer contagious.
If I do miss class due to COVID19 (myself or immediate household members) I understand that I can make up a class online or attend class later in person. I also agree that there are no refunds for any courses missed due to illness or other reasons. I also agree that if I refuse to sign this waiver, I will not be able to attend in person classes and there are no refunds.
DO NOT GO TO CLASS if you or your immediate household have any COVID19 symptoms, and call your health care provider right away and immediately notify Denver Real Estate School. Likewise, if you come into close contact with someone showing these symptoms, call your health care provider right away and notify Denver Real Estate School immediately. Be proactive and save a life!
By signing this agreement, I acknowledge the contagious nature of COVID19 and voluntarily assume the risk that I may be exposed to or infected by COVID19 by attending onsite classes. Further, I understand such exposure or infection may result in personal injury, illness, permanent disability, and death.
Therefore, I voluntarily agree to assume all of the aforementioned risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind; that I or anyone in my presence may experience or incur in connection with my attendance at onsite Denver Real Estate School training or any related in person participation.
I understand and agree that I release Denver Real Estate School from any claims (including all liabilities, claims, actions, damages, costs or expenses of any kind) based on the actions, omissions, or negligence of Denver Real Estate School, its employees, owners, agents, and representatives, whether a COVID19 infection occurs before, during, or after participation in any Denver Real Estate School classes or programs.
